E3.31 Reemployment After Military Service

This Policy shall at all times be interpreted consistent with the federal and state requirements for the equal employment of veterans including but not limited to 38 USC 4211-4215, 41 CFR 60- 250, and the Uniformed Services Employment and Reemployment Rights Act (USERRA). Any employee who is eligible for reemployment under USERRA shall be reemployed and reinstated by the College consistent with the Requirements of USERRA. A copy of the law (38 USC 4301-4335, 5 CFR 353) shall be available in the Office of Human Resources for review.

Reinstated employees will be granted the same seniority and benefits that they would have received if employment had not been interrupted.

If the employee chose to make contributions to the College’s retirement plan, the College will make any matching contributions that it would have made given continuous employment. Upon reemployment, the employee may make up missed contributions consistent with USERRA.

Vacation, sick, personal, bonus, or holiday time does not accrue during military service. Stonehill College will request documentation of military service when the employee contacts the Office of Human Resources after the completion of service. If documentation is not available, the employee will be reinstated; however, should documentation later become available and it shows the employee did not meet one or more of the eligibility requirements of USERRA, the employee may be terminated.
